AN ORDINANCE AMENDING NEWTON FALLS CODIFIED ORDINANCE SECTION 1161.02 ACTION BY THE NEWTON FALLS PLANNING AND ZONING COMMISSION.
WHEREAS, Ordinance 93-51 established zoning regulations for the City of Newton Falls and was passed by Council on December 6, 1993: and
WHEREAS, Newton Falls City Council adopted a Comprehensive Plan on December 1, 2014; and
WHEREAS, The Newton Falls Planning & Zoning Commission recently reviewed the Zoning of properties, compared them to the City of Newton Falls Comprehensive Plan for conformity; and
WHEREAS, The present notice provision of zoning amendments is unduly burdensome; and
WHEREAS, The ORC provides for a fair and manageable method of notification; and
WHEREAS, As a result of the review the Planning & Zoning Commission are recommending changes to the current Zoning of certain properties within the City of Newton Falls in order to conform to the Newton Falls Comprehensive Plan; and
THE COUNCIL OF THE CITY OF NEWTON FALLS, STATE OF OHIO, HEREBY ORDAINS:
SECTION I: Newton Falls City Council hereby amends Newton Falls Codified Ordinance Section 1161.02 (2) in reference to actions by the Newton Falls Planning Commission in order to conform to the Ohio Revised Code.
SECTION II: Notice of Hearing, Section 1161.02 (2) shall read: (a) Notice shall be in compliance with ORC 713.12; (b) amendments to rezone ten or fewer parcels require supplemental notice to property owners by the Clerk of the legislative authority. Said notice shall also be given at least 7 days in advance of a public hearing to the owner of the property and all property owners immediately adjacent to the property for which the rezoning is requested or his agent. Notification shall be by United States Post Office proof of mailing.
SECTION III: Any ordinance or parts of ordinances in conflict with the context of this ordinance are hereby repealed.
