ORDINANCE 2015 -13
AN ORDINANCE REQUIRING AGREEMENT OF PROPERTY OWNERS CONTIGUOUS TO CITY LIMITS TO ANNEX INTO THE CITY WHEN ADDING OR UPGRADING CITY UTILITIES
WHEREAS, The City is a supplier of utilities; and
WHEREAS, The City has adopted a Comprehensive Plan to provide for future economic growth while continuing to provide quality services to all citizens; and
WHEREAS, City Council wishes to increase its general revenue and reduce the strain on city services caused by adjacent urbanized areas.
WHEREAS, City Council has reviewed the operating expenses and current rates for utilities and feel new utility customer annexation is necessary to meet future needs of the City.
COUNCIL FOR THE CITY OF NEWTON FALLS, STATE OF OHIO, HEREBY ORDAINS:
SECTION I: Any property owner contiguous to the limits of the City seeking new or updated utility services shall execute an agreement to annex the property to the City or a petition for annexation to the City, as determined by the City. Such owner shall exert all efforts to obtain annexation of his or her property, including, if requested by the City, signing an annexation petition. In the case of an agreement to annex to the City, the owner of such land must also agree to require a similar agreement from anyone to whom he or she sells all or any part of his or her land.
SECTION II: Any ordinance or parts of ordinance in conflict with this ordinance are hereby repealed.
